The Chairperson of President William Ruto’s council of economic advisers, David Ndii, now says that it is not the job of the Attorney General to sign agreements on behalf of the government.
In a post on X, Ndii who was responding to former Public Service CS Justin Muturi’s claims on Friday morning said the Attorney General only gives legal advice and the greenlight to proceed.
Muturi, who formerly served as AG, in an interview, claimed he once received a phone call to sign documents related to a Sh129 billion deal while he was in transit in Dubai.
“AG does not sign agreements. S/he gives a written legal opinion giving the go-ahead for the government to enter into agreements. The agreements/contracts are signed by CS of relevant ministries,” Ndii said.
Muturi, who was recently fired from Cabinet, said that the deal would have contravened the law as such funds must go through the Treasury and should not be channeled directly to a Ministry.
In the interview, Muturi detailed how his relationship with Ruto started deteriorating.
He also defended his record for the time he served as Attorney General.
According to Muturi, the records speak contrary to allegations indicating that he was 'incompetent'.
His remarks come a few days after President William Ruto said that he was incompetent while he served in the state law office.
“I don’t have to defend myself about that, the record is there for everybody to see. When I got there, we had committed ourselves in the manifesto that we will make the office of the state law independent. I went there, and I did exactly that with the concurrence of parliament,” Muturi said.
Speaking at State House during an Iftar dinner for Muslim leaders, Ruto accused Muturi of delaying the rollout of the Muslim Endowment Fund (Waqf) that had been proposed by Muslim leaders.
"I agree with you that the Muslim Endowment Fund has taken too long. There is no reason. I had a problem with the AG who was there; he was fairly incompetent, but we now have a competent lady, and I can assure you that the issue will be sorted out," Ruto stated.
