ODPP approves murder charges against OCS Talaam, five others

Of the six, three are police officers and the other three are civilians.

The Office of the Director of Public Prosecutions (ODPP) has approved murder charges against six individuals linked to the death of Albert Omondi Ojwang.

The suspects, including three police officers, are set to be arraigned at the Kibera High Court.

In a press statement released on June 23, 2025, the ODPP stated that the Director of Public Prosecutions (DPP) had, on June 10, 2025, directed the Independent Policing Oversight Authority (IPOA) to investigate the circumstances surrounding Ojwang's death.

This directive was issued in accordance with Article 157(4) of the Constitution of Kenya and Section 5(2) of the Office of the Director of Public Prosecutions Act, Cap. 6B.

Following the directive, IPOA conducted investigations and submitted the inquiry file to the ODPP on June 22, 2025, for review and legal direction.

Upon receiving the file, the DPP immediately formed a team of senior prosecutors to carry out a comprehensive assessment.

Based on their findings, the DPP approved the prosecution of six suspects for murder.

The suspects include police officers Samson Kiprotich Talaam, constable James Mukhwana, and Peter Kimani.

The other three suspects have been identified as John Ngige Gitau, Gin Ammitou Abwao, and Brian Mwaniki Njue.

The ODPP emphasised its commitment to the rule of law, constitutional principles, public interest, and the fair administration of justice.

This comes days after a Nairobi court ordered that police constable James Mukhwana be held for 21 days pending investigations into the death of blogger and teacher Albert Ojwang’.

Milimani senior principal magistrate Robinson Ondieki said the detention period would run from June 13, including weekends and public holidays, as investigations are carried out.

It assured the public that justice for Albert Omondi Ojwang will be pursued in accordance with legal procedures.

The suspects will now appear in court to face charges under Section 204 of the Penal Code, Cap.
