
The court has denied bond or cash bail terms to Ezekiel Muia Mutuku, who is facing charges of robbery with violence.
“I find that the investigating officer has presented compelling grounds to deny the accused bond,” ruled Principal Magistrate Ben Mark Ekhubi.
"I hereby decline to admit the accused person on bond."
Mutuku will remain in custody pending the hearing and determination of the case.
The decision follows an affidavit filed by Corporal Johnes Nyangige of DCI Parklands, opposing Mutuku’s release on bond or bail.
The officer argued that the accused is also wanted by South B Police Station over a separate case of a similar nature.
The affidavit further indicated that releasing Mutuku could compromise ongoing investigations, as other suspects allegedly linked to the crime are still at large and remain untraced.
Mutuku is accused of robbing Patel Kashyakumar Khantibhai of Sh999,000 while allegedly armed with a dangerous weapon and acting jointly with others not before the court.
He also faces a separate charge of being in possession of public stores, contrary to Section 324 of the Penal Code.
At the time of his arrest, he was reportedly found with a cap peak, a white canvas cap cover, and a National Police Service crown badge, items suspected to have been stolen or unlawfully obtained.
Mutuku was arrested in Eldoret and detained at Parklands Police Station.
His co-accused, James Ngewa—alleged to have driven the vehicle used in the incident was also arraigned at the Milimani Law Courts and released on a bond of Sh1 million.
Both cases are scheduled for mention on August 6, 2025, for further directions.
