State seeks 5 more days to hold CCTV technician in Ojwang' murder case

The state has filed a fresh application seeking to detain technician Kelvin Mutisya Mutava for five more days over allegations of tampering with CCTV footage related to the death of Albert Ojwang in police custody at Nairobi Central Police Station.

Mutava, the first respondent, is alleged to have been paid Sh3,000 to interfere with surveillance footage that could be crucial in determining the circumstances surrounding Ojwang’s death.

He was presented before Kahawa Law Courts on Tuesday alongside lawyer Ezer Nguono, who represents Bryan Mwaniki Njue, the second respondent in the matter.

Appearing before Magistrate Gideon Kiega Oenga, Directorate of Public Prosecution (DPP) Counsel Gichuhi informed the court that the new application, dated July 1, 2025, seeks extended detention of Mutava to allow completion of ongoing investigations.

“The applicant has filed a further application requesting the court to grant it five additional days to continue having him in custody,” State Counsel Gichuhi said.

The court directed that the application be served to the relevant parties for responses before further directions are issued.

At the same time, the prosecution requested the court to terminate proceedings against co-accused Bryan Mwaniki Njue, noting that he had already been charged at the Kibera Law Courts.

This position was confirmed by his lawyer, Nguono, during the motion hearing.

“We have charged Brian Mwaniki before the Kibera High Court under case number E010 of 2025, and therefore wish to have these proceedings against the second respondent terminated,” stated State Counsel Gichuhi.

Officer Commanding Station (OCS) Samson Kiprotich Talaam and five other co-accused persons were arraigned on June 23 in Kibera court to face murder charges in connection with the death of Albert Omondi Ojwang.

Those charged alongside Talaam include police officers, James Mukhwana, and Peter Kimani.

The other accused individuals are John Ngige Gitau, Gin Ammitou Abwao, and Brian Mwaniki Njue.

The case is now expected to proceed there.
